A GUESTBOOK OWNER is ALSO KNOWN AS A “OWNER REGISTRANT.” OWNER REGISTRANTS IS THE CATEGORY YOU FALL UNDER AS A USER IN OUR TERMS OF SERVICE AGREEMENT.
Welcome to our website guestbookgiant.com (collectively known as the guestbookgiant website). We maintain this website as a service to our users (“Users”). Treat this as You would any Terms Of Service Agreement (“Agreement”) or contract. By using our site, you are agreeing to comply with and be bound by the following Terms of Service. Please review the following terms, rules, conditions, and disclaimers carefully. If you do not agree to these terms, you should not review information or obtain services, graphics, images, goods or products from or through this site. Once you have used this site you are automatically bound by the terms of this agreement as well as any of the rules, privacy policy notices, eligibility requirements set forth at any of our website locations. By using any of our websites You have entered into an agreement with Ross Computer Solutions L.L.C and agree and accept to the terms and conditions stated in this Terms of Service Agreement and are bound by the terms (“Terms”) of the “Terms of Service Agreement” just as if you signed it Yourself.
When using our guestbook service we will provide you with easy to use instructions.
REGISTRATION:
If we find that any information that you have presented to us is invalid we may terminate your service at any time. In order for us to designate our service to you we must have a valid email address.
ONLY OUR ADS AND THIRD PARTY ADS POSTED THROUGH OUR PROVIDERS CAN ROTATE ON THE GUESTBOOK SERVICE PAGES WE PROVIDE.
Ross Computer Solutions L.L.C will be offering a referral banner exchange system for our registered guestbook, messageboard, poll, and quiz account registrants. Look for details and instructions at our website locations.
BRIEF OF OUR TERMS OF SERVICE AGREEMENT:

“Term of Service Agreement” is an Agreement of Terms, Conditions, Privacy Notices, Disclaimers and Rules that "Users", also known as the (“Guestbook owner”) must read and follow. Once You have used our website services or the content (“Content”) of our websites in anyway You have automatically accepted and agreed to the terms, policy’s, rules, disclaimers and conditions as set forth on the Ross Computer Solutions L.L.C Terms of Service Agreement, Rules and Privacy Policy Notice, which includes any requirements noted on the Ross Computer Solutions L.L.C website that You are using the services of.
RELATIONSHIP:
The relationship created by this Agreement is that of a “User, ALSO REFERRED TO AS A OWNER REGISTRANT, REGISTRANT or GUESTBOOK OWNER.” This person is a user of the service being provided. Nothing in this Agreement shall be construed to make either party the partner, agent, agency, franchise, employee, or representative of the other. This agreement should not be misinterpreted or construed to create an association agency, a joint venture, or partnership, or any type of company, between the parties or to impose any liability attributable to such a relationship upon either party. Neither party may enter into any agreements or act in any way on behalf of the other party in making an agreement.
GUESTBOOK SERVICE:
NON-ENDORSEMENT CLAUSE 1:
We do not endorse, represent, guarantee, warranty or defend the use of any sponsor, advertiser, affiliate, or co-branded partnering, or link, or the products or services you voluntarily sign up to use, receive, or provide information to. These service providers are your direct source for any conflict. We have no control or knowledge of your activities with them. You use any service provider at your own risk.
We provide our service as is, as available with no warranty, express or implied, including but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. Ross Computer Solutions L.L.C expressly disclaims any representation, endorsement or warranty that our website or service will meet any of your standards, requirements, or be error free, secure, uninterrupted, no verbal communications, communications outside our Terms of Service Agreement, creates a warranty of any kind.

PASSWORDS FOR REGISTRANT USER ACCOUNTS:
As a “Owner Registrant,” (also known as a “Guestbook Owner”) it is YOUR Responsibility to safeguard Your passwords. Do not give them out to anyone for it makes it possible for others to use, change or alter Your account and account information and you are solely responsible for your account. You may change Your passwords at any time to safeguard Your account. We do not recommend or permit You to share Your account with anyone, and advise You to safeguard Your passwords. However, if someone acts on your behalf, for your company (a subuser) we require you to inform them of their obligations to Ross Computer Solutions L.L.C and the terms and conditions set forth under our Terms of Service Agreement, our Privacy Policy Notice, and this our Rules. You hereby acknowledge and agree to remain the SOLE responsible party for the subusers actions or inactions. It is your responsibility to notify Ross Computer Solutions L.L.C at rcs@abcgiant.com if you believe your account has been accessed without your authorization. We do not keep your password on our database. Please keep your password in a safe place where you will remember it. When you sign up you will supply us with a password hint. If you forget your password we will be able to supply you with a password hint that will be emailed to you and that will help you recall your password.
Your right to use the Site is not transferable. Any password or right given to you to obtain information or documents is not transferable. The ownership of the service you voluntarily sign up for cannot be transferred to another party at any time.
GUESTBOOK TERMS:
1. YOU ACCEPT AND AGREE NOT TO POST, PROMOTE, SOLICIT OR SET-UP A WEBSITE WITH ADULT THEMES OF ANY KIND OR THEMES CONSIDERED UNLAWFUL OR LINK TO SUCH SITES. THEY ARE FORBIDDEN FOR OR USE IN CONNECTION WITH ANY SERVICE WE PROVIDE. ROSS COMPUTER SOLUTIONS L.L.C HAS THE RIGHT TO REFUSE ANY REGISTRATION LINKED TO OR USING THESE TYPES OF SUBJECT MATTERS.
2. YOU ACCEPT AND AGREE NOT TO POST, LINK TO, SOLICIT, PROMOTE A WEBSITE THAT PROVIDED INFORMATION IN ANY WAY OF ANY KIND RELATED TO WEAPONRY, INCLUDING BUT NOT LIMITED TO THE FOLLOWING CREATING, PURCHASING, BUILDING WEAPONS OR FIREARMS, TEACHING HOW TO CREATE OR BUILD FIRE ARMS, WEAPONS, OR PROMOTE DESTRUCTION, DAMAGE, OR ANY OTHER HARMFUL ACT RELATED TO SUCH.
3. YOU AGREE AND ACCEPT NOT TO PROMOTE, SUGGEST, SOLICIT, PORNOGRAPHY, WAREZ, MP3’s OR ANY OTHER HARMFUL MATTER THAT CAN HARM OR SUGGEST HARM TO MINORS IN ANYWAY.
4. YOU AGREE AND ACCEPT NOT TO PROMOTE, SUGGEST, SOLICIT HARMFUL MATTER TO ANYONE OR ANYTHING OR ANY ANIMAL.
5. YOU ACCEPT AND AGREE NOT TO USE OUR GUESTBOOK SERVICE AS AN ON-LINE STORAGE FACILITY, OR FOR USING OUR SERVICE, BANDWIDTH FOR ANYTHING OTHER THAN THE GUESTBOOK PERSONAL PAGES. GUESTBOOKGIANT HAS LIMITATIONS AND IF YOU PLAN TO USE THE GUESTBOOK FOR ANY PERSONAL PURPOSE THAT MAY BE QUESTIONALBE PLEASE CONTACT THE WEBMASTER BY REGULAR MAIL FOR APPROVAL BEFORE USING THE GUESTBOOKGIANT WEBSITE

YOU AGREE NOT TO POST INFORMATION THAT IS SLANDEROUS, THREATENING, LIBELOUS, RACIALLY, ETHNICALLY OR OTHERWISE OBJECTIONABLE MATERIAL OF ANY KIND, INCLUDING BUT NOT LIMITED TO, ANY MATERIAL THAT WOULD CONSTITUTE A CRIMINAL CHARGE, GIVE RISE TO CIVIL LIABILITY, OR VIOLATE THE RIGHTS OF OTHERS, IS HARMFUL IN ANYWAY, OR VIOLATES ANY APPLICABLE LOCAL, STATE, NATIONAL OR INTERNATIONAL LAW OR WOULD SERVE TO RESTRICT OR INHIBIT ANY OTHER USER FROM ENJOYING OR USING THE GUESTBOOK SERVICE. YOU UNDERSTAND AND AGREE THAT YOU WILL BE SOLELY RESPONSIBLE FOR ALL ACTIONS YOU TAKE WHILE USING THE SERVICE. YOU ACCEPT AND AGREE TO INDEMNIFY AND HOLD HARMLESS ROSS COMPUTER SOLUTIONS L.L.C. OR ITS MEMBERS, PARTNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES AGAINST, ANY CLAIM ARISING FROM ANY MATERIAL THAT YOU POST OR TRANSMIT.
7. YOU ACCEPT AND AGREE THAT WHEN USING OUR “GUESTBOOK SERVICE” AT HTTP://GUESTBOOKGIANT.COM YOU ACCEPT AND AGREE TO HAVE “ADVERTISING BANNERS OR TEXTS PROVIDED THROUGH ROSS COMPUTER SOLUTIONS L.L.C OR THIRD PARTY SPONSORS RUN ON YOUR PAGES OF THE SERVICE. THESE ADS, BANNERS, TEXTS MAY BE SUPPLIED BY OUR THIRD PARTY ADVERTISERS OR SPONSORS. THIS IS WHAT SUPPORTS THIS FREE SERVICE TO YOU. WE DO NOT ENDORSE THESE ADVERTISERS, THEIR SERVICES OR PRODUCTS. YOU ARE SOLELY RESPONSIBLE FOR ANY TRANSACTIONS YOU TAKE WITH THESE SERVICE PROVIDERS. ADVERTISERS HAVE THE RIGHT TO ADVISE US TO TERMINATE THE USE OF YOUR GUESTBOOK. 8. THE RESPONSIBILITY OF A GUESTBOOKS SERVICE REGISTRANT IS FAR GREATER THAN THAT OF ANY USER OR REGISTRANT. THE RESPONSIBILITY OF A GUESTBOOKS REGISTRANT USER IS GREATER BECAUSE YOU ARE ALLOWING VISITORS TO COME TO “YOUR” WEBSITE TO USE “YOUR” GUESTBOOK AND POST, RESPOND, SEND, RECEIVE MESSAGES. YOU ARE RESPONSIBLE FOR THE CONTENT ON YOUR WEBSITE OR ON A WEBSITE YOU ARE RESPONSIBLE FOR OPERATING. WE PROVIDE OUR USES WITH A FREE SITE,AND BANDWIDTH IS LIMITED
9. AS A GUESTBOOK SERVICE REGISTRANT YOU ARE THE OWNER OF THE SERVICE YOU HAVE REGISTERED TO USE AND CAN BE HELD LEGALLY RESPONSIBLE FOR THE CONTENT ENTRIES.
10. YOU MUST BE AWARE THAT BY ALLOWING VISITORS TO COME TO YOUR SITE AND POST INFORMATION YOU ARE SOLELY RESPONSIBLE FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH YOUR ACCOUNT AND YOU HAVE THE SOLE RESPONSIBILITY TO REMOVE, DELETE ANY INAPPROPRIATE POSTINGS.

IS NOT RESPONSIBLE FOR ANY OF THE CONTENT ON YOUR WEBSITE, YOUR PAGES AND DOES NOT ENDORSE, WARRANTY, OR ASSURE THAT ANY INFORMATION ON YOUR WEBSITE IS SUITABLE FOR ANY PARTICULAR PURPOSE IN ANY WAY OR IS ERROR FREE. YOU AGREE AND ACKNOWLEDGE THAT YOU AS THE GUESTBOOK OWNER AND CREATOR OF YOUR WEBSITE ARE SOLELY RESPONSIBLE AND LEGALLY ACCOUNTABLE FOR ALL OF THE ENTRIES SUBMITTED, TRANSMITTED, POSTED ON YOUR GUESTBOOK PAGES.
12. YOU ACCEPT AND AGREE THAT YOU ARE THE SOLE PARTY RESPONSIBLE FOR THE (“CONTENT”) LOCATED, POSTED, ON YOUR WEBSITE WHEN USING THE (“SERVICE”). ROSS COMPUTER SOLUTIONS L.L.C IS FREE FROM ALL LIABILITY ASSOCIATED WITH YOUR WEBSITE AND THE TRANSMISSION OF ANY MESSAGES, POSTINGS, INFORMATION, IMAGES, GRAPHICS, SOFTWARE, PHOTOS, THAT IS RECEIVED, SENT, UPLOADED OR DOWNLOADED THROUGH THE SERVICE WE PROVIDE. YOU ARE RESPONSIBLE FOR ALL POSTINGS SO MAKE SURE ANY CONTENT THAT IS POSTED THAT IS COPYRIGHTED, TRADEMARKED, OR SERVICE MARKED THAT PROPER PERMISSION HAS BEEN GRANTED FOR USE. YOU ACKNOWLEDGE AND ACCEPT THAT YOU ARE LIABLE FOR ANY INFORMATION, MESSAGES, OR ANY OTHER MATERIALS THAT GET POSTED TO YOUR PAGES OF YOUR GUESTBOOK. MONITORING IS A PRINCIPAL RESPONSIBILITY. IT IS IMPORTANT TO DO AND ENABLES YOU TO ACT IMMEDIATELY AND DELETE BY (“UNAPPROVING”) ANY UNLAWFUL, INAPPROPRIATE, POSTINGS OF ANY KIND.
14. YOU ACCEPT AND AGREE THAT YOU ARE RESPONSIBLE FOR INFORMING YOUR USERS AND VISITORS OF THE RULES OF USING YOUR GUESTBOOK. YOU ARE RESPONSIBLE FOR MAKING IT CLEAR TO YOUR USERS THAT ANY INFORMATION THEY POST BECOMES PUBLIC DOMAIN, AND IS TREATED AS NON- CONFIDENTIAL. YOU ARE AWARE AND ACKNOWLEDGE THAT YOU HAVE HEREBY BEEN INFORMED THAT ALL INFORMATION THAT GETS POSTED TO YOUR PAGES IS NON-CONFIDENTIAL, PUBLIC DOMAIN AND NON-PROPRIETARY. 15. YOU ACKNOWLEDGE THAT ANY INFORMATION, SPECIFICALLY PERSONAL INFORMATION, THAT IS DISCLOSED, POSTED, OR OTHERWISE MADE AVAILABLE THROUGH YOUR GUESTBOOK PAGES, (E.I. VISITOR NAME, EMAIL ADDRESS, OR OTHER PERSONAL INFORMATION) MAY BE USED BY OTHER VISITORS OR USERS AND MAY HAVE NEGATIVE RESULTS.
16. YOU ACCEPT, AGREE AND PERMIT ROSS COMPUTER SOLUTIONS L.L.C ITS PARTNERS, OWNERS, MEMBERS, AND EMPLOYEES THAT ARE RESTRICTED BY CONFIDENTIALITY, TO MONITOR YOUR WEBSITE FROM TIME TO TIME IN ORDER TO CHECK OUT ANY COMPLAINTS OR SUSPICIONS OF ANY TYPE OF ABUSE, ILLEGAL ACTIVITY, INTELLECTUAL PROPERTY RIGHTS COMPLAINTS, OR ACTIONS THAT MAY BE CONSIDERED SUSPECT AND THAT MAY GIVE REASON FOR TERMINATION OF YOUR ACCOUNT. ROSS COMPUTER SOLUTIONS L.L.C DOES NOT HAVE TO ADVISE YOU OF ANY COMPLAINT AT ANYTIME OR A REASON FOR TERMINATION, UNLESS LEGALLY REQUESTED BY LEGAL COUNSEL AND UNDER THE CONSTRAINTS OF THE LAW.
17. WE DO NOT PERMIT SPAMMING OF ANY KIND POSTED ON OUR GUESTBOOK SERVICE PAGES THAT WE PROVIDE FOR YOUR USE.
18. YOU MAY NOT:

· Display any paid advertising or non-paid advertising on your service pages except for the ones posted by Ross Computer Solutions L.L.C or our service providers.
· Promote any pyramid methods of business.
· Solicit for advertisers or sponsors or any service providers other than those we supply to run on your pages provided through our service.
· Provide links or Exchange links on the website pages of the service we provide.
· Promote any kind of contest.
· Promote any weapon type instructions or links.
· Harm any individual or business entity in any way.
· Use the personal data posted about anyone without prior written authorized permission.
· Post any copyrighted, trademarked, service marked documents, images, graphics without written permission from the author.
· Violate any law, international, national, state or local.
· Absolutely no spamming.
· Tamper with source codes, or software, or any materials that may disrupt the service.
· You may not use our service as a storage facility of any kind.

19. YOU ACCEPT AND AGREE THAT YOU ARE RESPONSIBLE AND LIABLE FOR ANY (“SUBUSERS”) ACTIONS, TRANSACTIONS, MESSAGES, POSTINGS OR ANY ACTION OR INACTION TAKEN ON YOUR BEHALF BY A SUBUSER. WHEN SUBSUERS USE YOUR ACCOUNT YOU UNDERSTAND AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR THEIR ACTIONS.
20. ROSS COMPUTER SOLUTIONS L.L.C HAS THE RIGHT TO REMOVE YOUR “ GUESTBOOK SERVICE” FROM OUR DATABASE LISTING IF NO-ONE HAS SIGNED YOUR GUESTBOOK OR FOR THE PAST 120 DAYS OR IF THE GUESTBOOK HAS NOT BEEN VIEWED IN THE PAST 60 DAYS. ROSS COMPUTER SOLUTIONS L.L.C MAY CANCEL ANY ACCOUNT THAT WAS NOT ACTIVATED WITHIN 26 DAYS. ROSS COMPUTER SOLUTIONS L.L.C RESERVES THE RIGHT TO RESTRICT THE NUMBER OF ENTRIES TO THE MOST RECENT 500 ENTRIES IF OUR BANDWIDTH AND SERVER IS AFFECTED IN ANY NEGATIVE WAY, WE RESERVE THE RIGHT TO USE OUR JUDGMENT TO CANCEL ANY ACCOUNT FOR ANY REASON, AT ANYTIME, WITHOUT NOTICE OR EXPLANATION.
DISCLAIMER:

21. ALL RESPONSIBILITY OR LIABILITY FOR ANY DAMAGES CAUSED BY VIRUSES CONTAINED WITHIN THE ELECTRONIC FILE CONTAINING THE DOCUMENTATION, OR SOURCE CODE IS DISCLAIMED. WE WILL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT FROM USE OF OR INABILITY TO USE OUR WEBSITE OR THE SERVICE.
22. ROSS COMPUTER SOLUTIONS L.L.C DOES NOT GUARANTEE CONSTANT, UNINTERRUPTED ACCESS TO ANY GUESTBOOK ACCOUNT.

ROSS COMPUTER SOLUTIONS L.L.C, ITS OWNERS, MEMBERS, PARTNERS, AFFILIATES, EMPLOYEES CANNOT BE HELD RESPONSIBLE OR LIABLE FOR ANY ERRORS, DEFECTS, DAMAGES, INDIRECT, DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL AND EXEMPLARY DAMAGES OF ANY KIND, LOST PROFITS, EXPENSES, ARISING FROM THE USE OF OUR SERVICE OR WEBSITE. EVEN IF ROSS COMPUTER SOLUTIONS L.L.C HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES OCCURRING, TO THE FULLEST EXTENT OF THE LAW PERMITTING.
24. YOU UNDERSTAND AND AGREE THAT ROSS COMPUTER SOLUTIONS L.L.C SHALL NOT BE IN DEFAULT OR OTHERWISE LIABLE FOR ANY DELAY OR FAILURE OF ITS PERFORMANCE, LOSS OF DATA OR SERVICE FOR ANY REASON.

YOU WILL DEFEND, AND INDEMNIFY ROSS COMPUTER SOLUTIONS L.L.C ITS PARTNERS, OFFICERS, MEMBERS, EMPLOYEES, AFFILIATES AND CO-BRANDED AFFILIATES HARMLESS FROM ANY CLAIM OR DEMAND, DAMAGES, LIABILITIES, COSTS, AND EXPENSES, (INCLUDING REASONABLE ATTORNEY FEES AND EXPENSES) ARISING OUT OF THE CONTENT YOU POST TO, TRANSMIT, SEND, RECEIVE, SUBMIT THROUGH THE SERVICE, ON THE CONTENT PAGES, DURING YOUR USE OF THE SERVICE, IN YOUR CONNECTION TO THE SERVICE, INCLUDING YOUR VIOLATION OF OUR TERMS OF SERVICE AGREEMENT, OR IN YOUR VIOLATION OF THE PERSONAL OR BUSINESS RIGHTS OR THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS.

YOU WILL DEFEND, AND INDEMNIFY ROSS COMPUTER SOLUTIONS L.L.C ITS PARTNERS, OFFICERS, MEMBERS, EMPLOYEES, AFFILIATES AND CO-BRANDED AFFILIATES HARMLESS FROM ANY CLAIM OR DEMAND, MADE FROM THIRD PARTIES, INCLUDING LIABILITIES, COSTS, AND EXPENSES, (INCLUDING REASONABLE ATTORNEY FEES AND EXPENSES) ARISING OUT OF THE OPERATION OR IN CONNECTION WITH USING OUR SERVICE.
29. YOU WILL DEFEND, AND INDEMNIFY ROSS COMPUTER SOLUTIONS L.L.C ITS PARTNERS, OFFICERS, MEMBERS, EMPLOYEES, FROM ALL CLAIMS ASSOCIATED WITH CONTENT THAT IS POSTED ON YOUR SITE AND THAT RESULT IN DAMAGES, LIABILITIES, COSTS, AND EXPENSES, (INCLUDING REASONABLE ATTORNEY FEES AND EXPENSES) TO ANOTHER OR THIRD PARTY THAT ARISES OUT OF THE OPERATION OR IN CONNECTION OF USING OUR SERVICE.

YOU, AGREE TO DEFEND AND HOLD ROSS COMPUTER SOLUTIONS L.L.C HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DEMANDS BROUGHT BY US OR AGAINST US ALLEGING THAT YOU, POSTED OR DISTRIBUTED WAREZ, PORNOGRAPHY, ABUSIVE, HARMFUL, SLANDEROUS, LIBELOUS, OBSCENE CONTENT OR ACCEPTED OR POSTED ILLEGAL MATERIAL OF ANY KIND, MATERIAL THAT WAS DISCRIMINATING, OR THAT INFRINGED ON THE PRIVACY OR INTELLECTUAL PROPERTY RIGHTS OF OTHERS OR ANY ACT THAT IS IN VIOLATION OF THE RULES OR TERMS OF SERVICE AGREEMENT. ROSS COMPUTER SOLUTIONS L.L.C RESERVES THE RIGHT TO INVESTIGATE ANY SUSPICIONS THAT MAY BE DAMAGING TO OTHERS, OUR COMPANY, OR THE RIGHTS OF ANY THIRD PARTY. YOU AGREE TO INDEMNIFY ROSS COMPUTER SOLUTIONS L.L.C FROM AND AGAINST ALL DAMAGES, COSTS, BOTH MONETARY OR PUNITIVE THAT ARE AWARDED TO THIRD PARTIES, AND YOU WILL INDEMNIFY AND HOLD US HARMLESS AGAINST ALL CLAIMS, LIABILITIES, LOSSES EITHER BUSINESS OR PERSONAL. YOU WILL AGREE TO ACCEPT AND FUND ANY COSTS THAT ARE RELATED TO OUR EXPENSES, INCLUDING BUT NOT LIMITED TO LEGAL FEES AND ATTORNEY FEES, TRANSPORTATION COSTS THAT ARE INCURRED BY ROSS COMPUTER SOLUTIONS L.L.C OR ANY OF ITS PARTNERS, EMPLOYEES, OWNERS, MEMBERS OR AFFILIATES WHICH IS INCURRED BY US AS A RESULT OF INVESTIGATING ANY SUSPICIONS OR MATTERS THAT VIOLATE THIS AGREEMENT OR ANY LAW.
31. SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ALL SERVICES ARE USED SOLELY AT YOUR OWN RISK.
NON-ENDORSEMENT CLAUSE 2:

ROSS COMPUTER SOLUTIONS L.L.C DOES NOT ENDORSE, REPRESENT, INVESTIGATE, DEFEND; REFERENCE TO ANY PRODUCTS, SERVICES, PROCESSES, ADVERTISEMENTS, LINKS TO THIRD PARTIES INCLUDING BUT NOT LIMITED TO MANUFACTURERS, SUPPLIERS OR OTHERWISE DOES NOT IMPLY ITS ENDORSEMENT, SPONSORSHIP, OR RECOMMENDATION, NOR DO WE APPROVE OF ANY PRODUCT, SERVICE OR INFORMATION LOCATED ON OR THROUGH OUR WEBSITES OR PROVIDED BY ANY THIRD PARTY.

JURISDICTION:
This Agreement shall be construed and interpreted according to the laws of the State of New Jersey and all disputes arising under this Agreement shall be heard exclusively in the state courts of New Jersey in the county of Monmouth in the city of Marlboro. Any action taken must be filed only in the state or federal court of New Jersey, in the county of Monmouth. Each party hereby submits to the jurisdiction of such courts. The user agrees to comply with all applicable laws in using this service or the Materials. Any action brought by Ross Computer Solutions L.L.C or user based on or arising out of this Agreement shall be brought in the state or federal court located in said district of New Jersey. The parties agree that the U.N. Convention on Contracts for the International Sale of Goods shall not apply to this Agreement.
You acknowledge, accept and agree that Ross Solutions L.L.C manages its websites from its New Jersey location, located in the USA. You understand that we do not have knowledge of the Laws or Rulings in foreign countries or entities in regard to Internet or website related Use. Therefore it is Your sole responsibility to comply with the applicable laws in Your jurisdiction. Your access to any of our websites and use of any of our services is prohibited if illegal in Your jurisdiction, country or location and You agree to refrain from using our services in order to comply with the laws of Your jurisdiction, country or location. You take sole responsibility of any outcome, damages, losses and consequences personal or business as a result of Your of any of our services that are determined to be unlawful by the laws You are governed by.
If any one or more provisions contained in this Agreement are found by any Court of competent jurisdiction, or tribunal of competent jurisdiction to be invalid, illegal, unconstitutional or otherwise unenforceable, such invalidity shall not affect any other term or provision, and each and every other provision shall remain in full force and effect, and if a provision or term shall be deemed invalid only because of excessive scope of breadth, the provision or term shall be deemed valid to the extent of the scope and breathe permitted by law. This Agreement includes, our Privacy Policy Notice, Rules, and Terms of Service located under separate link at each website location but is considered an inclusive component of this Agreement. The Agreement contains the entire understanding of Ross Computer Solutions L.L.C and You (the User) with respect to the subject matter.
